FEATURES OF LEGAL RELATIONSHIPS IN TELECOMMUNICATION SERVICES

Tasks. Strengthening of a role of telecommunications in the modern world logically assumes profound civil theoretical development and the most fixed studying of legal regulation of activity of the organizations of telecommunication, that will provide improvement of the legislation and law-enforcement practice in the sphere of telecommunications. Unfortunately, the theoretical developments existing now in the Russian legal science, practically don't pay attention to the specified questions. Methodology.The methodological basis of research is made by the current situations of the operating civil law, which the regulate the activity of the telecommunication companies. This research enter the complex of the methods of knowledge developed as a result of scientific activity and scientific rationalization such as methods of the analysis and synthesis, structurally functional, comparative methods. Results.The carried-out analysis allows to differentiate legal statuses of telecom operator and organization of telecommunication and to offer original definition of the organization of telecommunication. The conducted system research of object of legal relationship with participation of the organization of telecommunication, including comparison of such categories as "telecommunication" and "electric energy", "information" and "signals in which the messages transferred on telecommunication network" allows to draw a conclusion that object of legal relationship which the organizations of telecommunication and consumers of services of telecommunication enter are such object as telecommunication services consisting in reception, processing, transfer and delivery of physical signals to which any messages sent on telecommunication network and contents of such messages has no legal value. The basis of emergence of such legal relationship is always the contract. In case of there is not of the contract it is the public communications. As a result the author distinguishes features of the legal relationship developing concerning rendering services of telecommunication. Application. The conducted research will allow to develop suggestions for improvement of legal regulation of the relations with participation of the organizations of telecommunication and consumers of services of telecommunication taking into account entry of community into a stage of global information community.
