Abstract:
The article deals with the theoretical analysis of the problem of the genesis of the judiciary and is determined by its place in the Russian political system. Particular emphasis is placed on the aspect of political science analysis. Attention is drawn to the desirability of a comprehensive study of the judiciary. It emphasizes the semantic difference between the use of the term "power" to the action of the courts and with respect to the legislative or executive authorities. It fixes the need to link the power of courts to the possibilities of legal system. On the basis of research as scientists and lawyers as well as political scientists are proposals to achieve the efficiency of the judiciary in the Russian political system.
