Abstract:
Background: At present, issues related to the place and role of the state and law for economics are of ever-growing interest. To solve this problem, it is necessary to conceptualize such aspects as personal liberty, freedom of enterprise and economic freedom. Only a detailed research of the aforesaid aspects can define the limits of the constitutional right to freedom of enterprise. Such foreign researchers as E. Asbjorn, F. Hayek, etc. paid attention to this issue as well. Materials and methods: Based on the opinions of law experts and having analyzed respective legislation as well as a broad range of Russian and foreign sources of literature, the author discloses the issues related to the role of the state in providing for the right to freedom of enterprise. Conclusions: The key problems related to the constitutional and legal support of the enterprise right as a legal form to implement the personal liberty in economic relations are caused by the absence of a systemic approach to the definition of the economic order in the Russian Constitution. Basic constitutional and legal regulation of the enterprise right in the course of the Constitution update demands changes in the means of regulatory provision of the freedom of enterprise and clear definition for the subject matter of the right
