Abstract:
This article is devoted to legal and procedural characteristics of the application of a preventive measure in the form of detention. Criminal problems and civil liability for the implementation of the responsibility of obviously illegal sentences, decisions or other judicial acts are highlighted in this article. Some gaps in the legislation which violates international, constitutional principles require precise regulation and implementation.
