Abstract:
Objectives: To evaluate of resource supply contract, determine its place in the Russian legislation, to identify the legal property resource supply contract, bring the definition of resource supply contract. Model (methodology): a comparative legal, system-legal, logical and theoretical methods of structural and functional analysis. Conclusions: The main features of the contract are derived resource supply contract: special object - a resource; the special nature of the transmission - through the connected network (the characteristic features of this transfer are the generic definition of the subject, subjective uncertainty actors network communications, the indication that the transfer of resources can be unilateral and passive actions); especially in the subject composition; especially in the content of the agreement (mainly particularly obligations of the subscriber); and the special procedure for determining the price of the resource. The Treaty itself we characterized as mixed, consensual, bilateral, bilateral, onerous, the public, the merger agreement, which has a technical content. Scope of the study / possibility of further use of the results of research: the study is limited by Russian law and Russian law enforcement, the use of limited resources in the provision of public services in apartment buildings (non commercial use) / possible use of legal practitioners resource supply companies and management companies in the course of employment. The practical significance: some theoretical conclusions can serve as the basis for the guidelines and applied in practice regulatory authorities and courts; Materials research can be used in training sessions on civil and housing rights. Social consequences: the findings may be used in the formation of the legal framework of housing policy in Russia. Originality / value: the study is still little-known civil legal relations in connection with the adoption of new rules for public service, their classification, identification of contradictions, the first comprehensive study of the current regulation and adjustments resource supply volumes of municipal resources, generalization of judicial practice in this area.
