Abstract:
The article is devoted to some unsolved problems related to effective criminal and legal protection of intellectual property. The article deals with the conceptual apparatus of intellectual property in criminal law, civil law and international law. The article analyzes the content of the concept of intellectual property, intellectual activity. The article illustrates the issues related to the design of the criminal offences, providing for liability under articles 146, 147 and 180 of the Criminal code of the Russian Federation. Special attention is paid to the objective party of the considered corpus delicti. So, the question of a legislative typographical error of the large damage in disposition of article 146 of the criminal code and the large size in the note of the specified article is raised. Difficulties of the design of the objective party of the considered structures of crimes and impossibility of determination of intellectual property in regulations of the Criminal code of the Russian Federation, lead to extreme inconclusive criminally-legal protection of this property right.
