Abstract:
The main reason for writing the article was acute social tension on the issues of legislative regulation of shared construction and increase in the number of litigations in this area. The purpose of the work is to analyze the current legislation in the field of shared construction, regulating the issue of changing the price of the contract of participation in shared construction, identifying gaps in legal regulation and formulating proposals for resolving the problem identified. Currently, in the legal relationship between the participant in the shared construction and the developer, there is a regular question of changing the price of the contract due to the discrepancy between the project area of the premises and the actual area after the completion of the construction of the apartment building. The authors, using the method of analysis and comparison, studied the provisions of the federal legislation in the field of shared construction and materials of judicial practice with a view to generalizing the results of the study. The method of modeling in the article formulates proposals for improving legislation in order to simplify and specify the procedure for changing the price of a contract of fate in shared construction after the developer receives permission to put the facility into operation. Based on the study conducted by the authors, the necessity of introducing changes to the current legislation on shared construction is justified. The practical importance of the proposals presented in the article will allow to reduce the growth of litigation between the developer and the participants in the shared construction and simplify the procedure for concluding and executing the agreement for the parties, which will undoubtedly have positive social consequences.
