Abstract:
In this article the author discusses the features of criminal liability for making false information in the register of the securities owners (part 3 of the article 1852 of the Criminal code of the Russian Federation). Thus, research is spent both on the basis of norms of criminal law, and on the basis of the norms containing in regulatory legal acts of other branches of the right (the civil and financial right). Also in operating edition of specified article a number of blanks are revealed and, as consequence, with a view of optimization of the criminal legislation concrete changes of the given norm are offered and given reason. The carried out analysis presumes to solve the individual questions arising in practice in connection with qualification of crimes committed on a securities market.
