This article describes the issues and problems of the judiciary and private mediation in Australia for example, the state of New South Wales. Analyzed the categories of cases that can be sent to mediation, considered the procedure of judicial and private mediation, the mediator of the problem and the role of the parties in it. The problems of judicial mediation and identifies solutions. Formulated a set of rules, compliance with which facilitates mediation. Assessed the prospects for the development of mediation in Australia.
