Abstract:
The author analyzes the Rules of mediation and arbitration in Financial Dispute Resolution Center (FDRC) in Hong-Kong. The procedures of mediation and arbitration are investigated: stages, sequence, choice of the mediator/arbitrator, language, confidentiality. The basic principles of financial disputes resolution is based on simplicity, speed and efficiency. In the procedure of mediation the active role is occupied by mediator, he chooses the order of the procedure from an expediency position. The arbitration is based on writing form that considerably accelerates process, except for the cases connected with complexity of business or the party insist on carrying out oral hearings. The main difference of this center is the subject structure of the parties.
