Annotation:
This article considers the delegated legal capacity in family relations. Problems of branch legal capacity are of considerable interest for legal science, but with the seeming diversity and breadth of research, many properties and mechanisms of legal capacity require additional research, including in family law. The study used the following methods: General scientific dialectical method and the resulting private-scientific methods of cognition, such as logical, formal-legal, systemic, etc . Theoretical basis the study is based on the conclusions drawn by jurists, developing the topic, in particular: V. A. Belov, V. I., Sinai, Ya. M. Magaziner, E. S. Vorozheikin and others. The article is devoted to the analysis of the status of delegated legal capacity and the question of whether the legal capacity is an integral property of the subject of law or it is an artificial legal entity arising by virtue of the legal will of the state. The study concluded that the delegated legal capacity in family law should be understood as the ability of subjects of family law under certain conditions provided for in the legislation to have family rights and obligations belonging to other participants in family relations. The institution of delegated legal capacity is subject to further study, it is necessary to determine the signs of delegated legal capacity in relation to each of the types of family legal personality; it is relevant to identify the content of the delegated family legal personality and other characteristics of this legal form.
