LEGAL REGULATION OF TRADITIONAL FISHERY OF INDIGENOUS PEOPLES IN CANADA AND THE RUSSIAN FEDERATION (COMPARATIVE LEGAL RESEARCH)

Task. The article is devoted to comparison and analysis of the contemporary legal regulation of traditional fishery of indigenous peoples in Canada and the Russian Federation. Distinctive attention is paid to the general understanding of the concept of the aboriginal rights of indigenous peoples in Canada. It is important for studying and conceivable reception of the Canadian traditional fishery regulation experience in the Russian Federation. Model. In the article systematic and formally legal methods of cognition are used. Conclusions. In both countries, at the constitutional level, the special rights of indigenous peoples are recognized. In Canada, the right of indigenous peoples for traditional fishery has gained further interpretation and development in decisions of the Supreme Court of Canada. The decisions passed by the Supreme Court on the queries of traditional fishery have laid the foundation for the understanding of the aboriginal rights in general. Interpretation of the aboriginal law in Canada proceeds from the fact of accommodation and implementation of the specific indigenous practices before the arrival of the Europeans. The specified factors are crucial for consideration of the traditional fishery legal queries, despite their discrepancy too, such as the Federal Act on Fishery. In the Russian Federation, though the right of indigenous ethnic groups for the traditional fishery is regulated by various acts, the judicial practice has shown that regulatory provisions do not always consider a traditional way of life of these peoples, their self-ingenuity, requirements and opportunities. Therefore, the traditional fishery right realization causes difficulties. Value. This article can be of interest to the experts who are engaged in studying of a legal status of indigenous peoples of Canada and the Russian Federation, as well as in studying of problems of their protection. In addition, the experience of protection of the rights of indigenous peoples in Canada can have an important practical value in law-enforcement practice and in development and improvement of the legislation of the Russian Federation.
