The Principle of the Language of Criminal Proceedings: Concept and Mechanism of Implementation

Abstract: The paper examines the problematic issues of defining the concept of the principle of the language of criminal proceedings and the criminal procedural mechanism of its implementation. The author substantiates that this mechanism consists of two components: a mechanism for protecting the rights and freedoms of participants in criminal proceedings who do not know or do not sufficiently know the language of legal proceedings and a mechanism for ensuring the realization of the rights and legitimate interests of such persons, which constitute a single criminal procedural mechanism for implementing the principle of the language of criminal proceedings. The elements of the mechanism of implementation of the principle under consideration are revealed and the need for its improvement is justified.
