Abstract:
Background: The term pactum is used in the pre-classical period of roman law in the literary sources to express the concept of conventio, oriented to establishment and termination of the obligation. The aim of the article is to show, that the consensual agreements as the source of obligation arise long time before the formation of the institute of contract. Sources and methodology: In the article were used the literary sources of the roman authors – first of all the comedies of Plautus and the tractates of Cicero – because they give a rich material about the term pactum in the practice of the social relationships of the ancient romans in the pre-classical period of the Roman law. For their analysis we used the traditional for the history of law method of the legal exegeses. Results: On the basis of the results of research, expressed in the article, we showed, that the social practice of the establishment of the obligation on the basis of the simple convention arises and diffuses long time before the legal formalization of the institute of the contract. Conclusion: The analyzed sources, methodology and the original conceptualization about the roman legal heritage allow us to estimate from the new point of view the development of contract in the Roman law in the pre-classical period on the basis of the history of the term pactum.
