Abstract:
Background: The carriage of goods by sea in the Roman law had different forms – lease contract and the carriage by sea in the strict sense. In the article are analyzed different forms of the carriage by sea in the pre-classical and classical periods of Roman law and particular approach suggested by Marcus Antistius Labeo for the problems connected with the contract typicality in the Roman law. Sources and methodology: In the research we used the literary, epigraphic and legal sources of the Roman law. The analysis is based on the methodology of the legal exegeses. Results: During the research we arrived to conclusions, that the most ancient legal form of the carriage of goods by see is the lease contract, connected with the specific agreement, regarding the transport of goods. In the classical period of the Roman law two forms of carriage of goods by see draw together. It brings to the difficulties by the choice of the procedural remedy for the disputes arising from the contract. Conclusion: In the research we found out the main legal forms of the carriage of goods by see, used in the pre-classical and classical periods of the Roman law, and specific legal claim, used by the problems of the contract typicality, connected with the similarity of the legal forms of the carriage of goods by sea.
