Abstract:
This article presents the analyses of the real impact of the principle of “the freedom of contract” upon social conditions in totally monopolized markets. The author examines the historical and practical aspects of the problem of the principle of "freedom of contract" in Russia. It explores the understanding and influence of this principle in the framework of the current economic system, considering the completeness of the wording the basic principle of civil law legal regulation of the real needs of the prevailing socio-economic realities. The paper provides a detailed overview of the leading codification for 200 years, which allows you to come to the author to the reasonable conclusion that the declaration "the freedom of the contract" is an exception to the general silence, having the obvious purpose to point out the limitations of this "freedom", there are two contractual constraints model freedom. This article is of great interest not only as a theoretical study. Article Submissions will be useful in practice.
