Abstract:
The article analyzes the practice of application of the customary law by the volost courts, established in the result of the peasant reform of 1861. As the only form of peasant justice, recognized by positive law, the volost court should be considered significant and progressive institution that would foster greater protection of the rights of peasants. However, usually the volost court resolved relatively small number of cases, because the villagers tried to decide existing disputes among themselves with the help of village meetings, courts of elders, neighbors, who usually carried out the reconciliation of the parties.
