ABOUT PRACTICE OF THE VOLOST COURTS (ACCORDING TO THE CENTRAL STATE ARCHIVES OF THE REPUBLIC OF MORDOVIA)

Abstract:
The article analyzes the practice of application by courts of customary law on the base of the data of the Central state archive of the Republic of Mordovia. The author gives the court issues in the field of marriage and family, land and property relations. There is raised the problem of insufficient understanding of the customary legal order of the Mordvins, its incorrect interpretation by the official bodies of justice. Volost court and Uezd Congress decisions repeatedly emphasized the priority of tradition over the law, but, guided by tradition, interpreted in isolation from the general context of regulation, the essence of customary legal order is often distorted.
