THE CAUSES OF HUMAN RIGHTS VIOLATIONS IN MEMBER STATES OF THE COUNCIL OF EUROPE

Tasks: The main aim of this work is the need for detailed studies of the main causes of human rights violations in member States of the Council of Europe. The relevance of this topic due to the keen interest of domestic (S.A. Glotov, E.D. Kostyleva, I.I. Lukashuk, etc.) and foreign (M. Janis, R. Kay, E. Bradley) legal scholars to the subject, as well as the need to attract the attention of the world community to the problem of human rights violations in member States of the Council of Europe and improve the efficiency of the protection of fundamental rights and freedoms of man and citizen. Model: Methodological base of research forms a set of different methodological techniques and means of knowledge. Given the complexity of the monitoring subject uses General philosophical, General scientific, private, and special methods of cognition, in particular: comparative, documentary analysis, formal-legal, formal logical and some other methods. Conclusions: Despite international and European pravoohranitelej regulations, the problem of effective protection of human rights continues to be relevant. The situation is directly reflected in the number of complaints under consideration at the European court of human rights. Many member States of the Council of Europe upon ratification of some international and European normative legal acts made reservations to ease their implementation from their side, whereas the Russian Federation has minimized the number of reservations (for a number of regulatory legal acts, they were removed later, such as the Convention on the elimination of all forms of discrimination against women), which allows it to be a full participant of the most Pravobulachnaya international and European regulations. Originality/value: The present study is aimed at teachers, graduate students studying the causes of human rights violations, as well as anyone interested in current problems and current state of protection of fundamental rights and freedoms of man and citizen in the member States of the Council of Europe.
