The challenge facing the author of the article consisted in the analysis of formation and development in the Russian Federation the Commissioner for human rights, and to define its place in the system of bodies of state power. The conducted research allowed to determine the special status of the Commissioner for human rights in Russia, which is due to the challenges they face, the main of which - the control of observance of legitimate rights, freedoms and interests of citizens in the activities of Executive authorities and officials. There was a significant features that are unique to this institution. Model: this work was based on methods of empirical and theoretical research, traditional dialectical and formal logic. Such methods as formal-dogmatic, statistical and others were used. Their use contributed to the study of the objects of interest to the author in their interrelationship, integrity, allowed for a comprehensive and objective study. Conclusions: the conducted study allowed to conclude that the institution of the Commissioner for human rights in the Russian Federation occupies a special place among public authorities. The author emphasizes that the institution legally cannot be attributed to any of the branches of government. The status of the Ombudsman is enshrined in the rank of the highest positions of the state. The Institute acts as a link between the government and the society, contributing to the smoothing of contradictions between them, protecting the rights and freedoms of man and citizen. Its value lies in the availability of an appeal to him for protection. Value: the work can be useful to law students, primarily when considering the number of topics for the course «Constitutional law of the Russian Federation», special courses «Human Rights», as well as other disciplines of the educational process, which affect the mechanisms of protection of the rights of man and citizen.
