Abstract:
The article analyzes the criminal procedural aspect of the fairness of the application of preventive measures in the course of criminal proceedings. The criteria for the fairness of the trial, taking into account international legal acts and decisions of the European Court of Human Rights, are indicated. Conclusions are drawn regarding the need to comply with the equality of the parties in the adversarial proceedings in the selection of preventive measures, the legality of this decision in the criminal case, the inadmissibility of deviating from the requirements of direct examination of judicial evidence.
