LEGAL ISSUES OF AGREEMENT APPLICATION FOR PAYMENT MINORS' SUPPORT ORDERS IN RUSSIA

The possibility for parents to reach an agreement on the payment of alimony for a minor without going to court is certainly a significant step in Russian legislation brought by the Family Code of the Russian Federation. The article analyzes the legislation of the Russian Federation, scientific work and judicial practice. In the Russian Federation, it was long overdue to revise approaches to the fulfillment by parents of their duties in case of a divorce in the direction of a more careful consideration of each parent’s contribution to the upbringing and development of the child. Divorce does not exempt from parental obligations, and does not give the right to ignore the needs of the child in the harmonious upbringing and development. Legislative establishment of clear criteria for determining the essential terms of a maintenance agreement, the size, form and methods of paying maintenance, the dependence of the amount of paid material maintenance on the degree of participation in the minor’s life will ensure first of all the maximum protection of the interests of the child. The introduction of the mandatory harmonization of the terms of the agreement with the guardianship authorities will ensure the stability of alimentation agreements. Divorce is a difficult stage in the life of adults, but passing through it must not forget about the interests of the most vulnerable participants in divorce and children. The agreement on the payment of alimony is not able to completely eliminate all the negative, but its conclusion can help reduce the urgency of the situation.
