Abstract:
The content of the article is aimed at clarifying problematic aspects of the realization of the rights of persons insured in the system of compulsory pension insurance for early old-age insurance pensions in connection with working in special (productive) working conditions. In order to more fully cover the identified problem, the authors proceed from the need for a detailed analysis of the grounds and conditions for the assignment of early insurance pensions under special conditions, which was made on the basis of theoretical provisions of the science of social security law, current pension legislation, and the Federal Law of October 3, 2018 No. 350 - Federal Law «On Amendments to Certain Legislative Acts of the Russian Federation on the Purpose and Payment of Pensions», which comes into force on January 1 2019. The main attention of the authors is drawn to the problems of establishing qualitative and quantitative indicators of special insurance experience (length of service on relevant types of work). It proves the need to improve the procedure for confirming and setting work periods that determine the right to assign early old-age insurance pensions in connection with special working conditions. It justifies the need for fundamental changes in the legal regulation of documents, aimed at fixing the nature of work on the part of the employer - the insured.
