THE HISTORY OF LEGAL MECHANISMS TO COUNTER THE MANIFESTATIONS OF FASCISM AND NAZISM IN THE UNITED STATES

Task: The Revival of far-right movements with pronounced Nazi and fascist ideals is a serious problem not only for Russia, but also for the majority of European States. However, according to the author, the United States of America have a special place in this matter as a country of great differences. As a peculiarity the racial superiority of white people was an irrefutable fact for American society even before the creation of the Third Reich in the country. Since the 18th and 20th centuries to the present time this opinion has a significant number of supporters. The research is necessary to cover the history of legal mechanisms to counter the manifestations of Fascism and Nazism on the example of the United States as well as to search for positive experience in the domestic legal system. Model: The analysis of scientific literature and legal acts of the USA containing information on the research topic was carried out. Conclusions: The US Legal system in terms of creating norms of counteracting Fascism and Nazism manifestation has gone a long and agonizing way before forming a sufficient base that can counter these phenomena. There are still serious problems in it though. The solution lies in the rethinking of the rights of citizens enshrined in the US Constitution. Originality: The scientific article contains debatable questions and touches on sensitive topics for American society and the legal system of the United States.
