FORMATION OF SYSTEM OF ADMINISTRATIVE JUSTICE IN THE REPUBLIC OF KAZAKHSTAN: PROBLEMS AND PROSPECTS

The paper is devoted to study of problems of formation of system of administrative justice in the Republic of Kazakhstan and prospects of its development. The problem of ensuring the rule of law, strengthening the rule of law, and respect based on the rule of law in public administration, local public administration and self-governance, the author relates the lack of the Republic of Kazakhstan the specialized system of administrative justice. The author examines the problems associated with the procedural order of consideration and the permission of separate categories of cases in administrative proceedings, which proceedings for Kazakhstan, represented a fundamentally new form of administration of justice. In this part also addresses the issue of determining the jurisdiction of cases pending before the courts and resolution of administrative justice, as well as jurisdiction of cases related to the competence of higher state bodies and local self-government or their officials in the order of subordination.
