Distinctive Features of Functioning of the Domestic State and Law in February-October 1917 - in the Late 80s - in the Early 90s in XX Century

The article deals with the possibility of system methodology application in studying the state and law of the transitional period. Purpose: to conduct the comparative analysis of domestic state and legal superstructure in two transitional historical situations: in February-October 1917 and in the late 80s - in the early 90s of XX century on the basis of available system methodological tool. Methods: the methodological basis of research are the system and historical methods allowing to reveal the quality content of state and legal matter of the transitional period as well as to study the distinctive features of system changes in state and legal superstructure in transition from one public system to another. Results: during research on the basis of element correlation analysis of state and legal superstructure to strategic development of the competitive public systems the distinctive features of the state and law for the transitional period are distinguished in two historical situations. Conclusions: "system", "nonsystem", "intersystem" categories of system methodology help to carry out the detailed analysis of state and legal superstructure in the process of changing the public systems. In addition to common typology features, the specific features of the state and law are marked in two transitional historical situations, since the content of the collapsing public systems is of another quality.
