Abstract:

The goal of article: this article is dedicated to actual criminal law problem of female circumcision’s criminalization. This problem has become actual because of current draft that concerns the criminalization of female circumcision. Draftsmen propose to include this crime in chapter 19 of Russian Criminal Code “Crimes against constitutional rights and freedoms”. Method. The comparative method used in this article enables better understanding of Russian criminal law’s rules and also determines the main direction of Russian criminal law’s development. Results of study. There is no necessity to criminalize female circumcision because of existing crimes that can be applied to such action. The originality and practical value. This article can be of interest for students, PHD-students and everybody who is interested in German criminal law.
