Abstract:
The most important trend in modern labor relations is to enhance flexibility and the occurrence of atypical forms of employment, including the emergence of agency labor. The problem of agency labor is given considerable attention in the foreign science (Durand P., Schiek D, S. Hausman, Houseman, S., Kalleberg A. etc.) as well as domestic jurisprudence (A.M. Lushnikov, N.E. Yakovenko, F.A. Supryaga et al.). With the adoption of the Federal Law № 116-FZ, the use of agency labor in the Russian Federation is legally prohibited, while at the same time the work of employees, who are temporary sent by employer to other individuals and legal entities is allowed. In this regard, there is need in comparative analysis of these two forms of employment to identify the specificity of relations in this sphere. Using the method of analysis and comparative legal method, the authors shows in the article the features of agency labor and labor of employees, who are temporary sent by employer to other individuals and legal entities. Particular attention is paid to the characteristics of labor of employees, who are temporary sent by employer to other individuals and legal entities (subject structure of this relationships, specifics of contracts, and specifics of wage and so on.). Authors concluded that there are some similarities between agency labor and labor of employees, who are temporary sent by employer to other individuals and legal entities. Also there is the need to improve labor law, since the gaps and conflicts in labor legislation today create the conditions for the violation of labor of employees, who are temporary sent by employer to other individuals and legal entities. Results of the study may be useful to professionals involved in the study of the current state of labor relations; practicing lawyers; employers who expect the provision or use of employees, who are temporary sent by employer to other individuals and legal entities; as well as all who interested in the current state of labor law in Russia.
