PROTECTION OF THE EMPLOYEE’S RIGHTS TO PENSION BENEFITS IN CASE OF EMPLOYER’S INSOLVENCY: THE ANALYSIS OF WORLD EXPERIENCE AND ITS POSSIBLE USE IN RUSSIA

Background: In this article on the example of experience of different countries are reviewed and analyzed methods that protect the rights of employees to pension benefits in case of insolvency (bankruptcy) of the employer. In conditions with the appearance in Russia of different types of voluntary non-state pension provision, there is a high social importance of this issue, which makes it of relevance. The aim of the research is to analyze and identify, based on overseas experience, the most effective ways of improving the protection of employee claims pension benefits in insolvency of the employer in Russia. Along with local experts, research to develop the most effective measures of legal protection of employee claims in case of bankruptcy of the employer, shall be held by such foreign scientists as Johnson G., Joseph Lichterman, Marte J., Chris Isidore, Secunda P.M., C. Yermo J., Severinson C., Janis Sarra. Materials and methods: Methodological and the oretical basis for the study was the works of domestic and foreign experts in this field. Of great importance in theoretical and practical aspect was generalizing scientific principles and mechanisms for the protection of the employee rights to pension benefits connection with insolvency in foreign countries. During conducting the research and presenting the material were applied scientific approaches (system approach) and methods of scientific cognition (analysis, deduction, scientific abstraction). Conclusions: On the basis of the conducted research, accordance with current economic situation the author of the article analyzes of the international experience in this area, gives conclusions, justifies it, the author gives their rationale, and suggests measures to improve the protection of employee claims to pension benefits in insolvency of the employer in Russian Federation. Thus, in particular, the author leads the classification of types of pension plans in different countries of the world, describes their characteristics and methods of legal protection of pension savings of employees through the system of privileges and guarantee funds. The author of the study analysis and points out the advantages and disadvantages of a number of legal acts to be adopted in order to regulate legal relations in this sphere in Russia. Target audience: The publication can be useful for scientists and practitioners involved with solving problems in the protection of employee claims in insolvency of the employer, and graduate students involved in the study of the considered problem.
