Abstract:
Tasks. The article describes the legal basis and modern problems of development of mediation Institute in Russia. Identify further implementation of mediation procedures in practice. Methodology. Using the formal-legal method and method of analysis of documents analyzes the legislation that enabled to give the essential characteristics of the study and to identify standards that require further development. The method of content analysis (formal, qualitative and quantitative study of various scientific and information documents) helped to identify positive and negative trends in the implementation of mediation in the reality of the Russian Federation. Insights and suggestions. The mediation procedure is considered as an effective and quick method of resolving various disputes and conflicts, which can be a real alternative to state court litigation. This institution in Russia today has a legal background, but there are many gaps of normative regulation. Legislative provisions on mediation are mostly declarative, therefore it is necessary to solve a number of difficult tasks on their improvement. Should develop ways of integrating mediation procedure in civil and arbitration processes. Much remains to be done to further the development of the Institute, to enhance awareness of modern business community, legal practitioners, with the aim of active implementation of this Institute in practice. The conditions for achieving the quality of mediation services is the special training of mediators, improving their professionalism. As a prerequisite to the mediator should be the presence of higher legal education. It's important the increased use of mediation (the introduction of mandatory mediation in Russia in the first stage of its development), etc.
