Abstract:

In article analyses Hegel's philosophical views on the problem of non-law; recently disclosed them as an unintentional non-law, deception, coercion and crime. In this work emphasizes attention on Hegel's interpretation of punishment as a removal of crime. Author of article substantiates the idea, that subsequent development of law revealed another form of non-law, when state, that should express general interest, in fact, expresses its own interests with little regard for interests of individuals and created illusion of general will, and civil society in this model, either alone treated from perspective of law, or is excluded from it, in any case, leads to certain contradictions.
