Abstract:
The Chinese legal system and judicial system of China are definitely the most foundational building blocks in terms of shaping and determining the whole regime on the recognition and enforcement of foreign judgments in China. These two aspects provide the most important bases as well as guidance for one to organize the proceedings and formulate the litigation strategies concerning the recognition and enforcement of foreign judgments in China. In the meanwhile, however, it is beyond any doubt that the operation of law and the functioning of a judicial system explored above. That is to say, to understand Chinese law and judicial system never equals a mere description, juxtaposition or even deep analysis confined to the statutes and court proceedings or decisions. The article considers and analyses the main hidden factors influencing the recognition and enforcement of foreign judgments in China.
