Abstract:
In article the modern problems of application of article 214 of the Criminal code of the Russian Federation concerning qualification of the crime provided in it - vandalism are allocated and considered. The author pays attention to problems of the correct legal assessment of act taking into account the objective and subjective signs of structure of vandalism stated in the criminal law and also to difficulties of an otgranicheniye of this encroachment from adjacent structures of crimes. Thus in article the ways of overcoming of the allocated problems directed on improvement of the criminal legislation and practice of its application are offered.
