Abstract:
Task. The article is devoted to theoretical questions connected with the definition of the place of habits in the mechanism of the legal behavior of the individual. Model. The goal was achieved through the use of traditional methods of scientific research, among which the dialectical method takes the leading place. The authors outlined the main characteristics of the relationship of habits and rights and concluded that human behavior in the field of law has the property of typification. Based on this, the paper analyzes the main research approaches to the definition of the concept of «legal habit». Based on the analysis of theoretical and legal literature, statistical data and the results of a specific sociological study, the authors formulated some legally significant properties of habits. Conclusions. The conclusion is made that the content of legal habits is related to the level of the legal consciousness of the subject and is caused by the specificity of the turnover of legal information in the society, the duration of the rule that has become a habit, and other social and non-social factors. Originality / value. The findings can lead to further study of the category of legal habits, in particular, the development of measures to eliminate legal habits of unlawful behavior.
