CRIMINAL LIABILITY FOR THE ORGANIZATION OF AN ILLEGAL ARMED FORMATION AND PARTICIPATION IN IT

The article deals with topical issues of the rule providing for criminal liability for the organization of an illegal armed formation and participation in it. Examples from judicial practice are analyzed, the draft of change in Art. 208 of the Criminal Code of the Russian Federation is resulted. The purpose of the article: The present work aims to study the problem of the broader interpretation of the article, the violation of the principle of justice and the lack of individualization of criminal responsibility for the organization of illegal armed formation and participation in it. The authors aim to eliminate the problems he sees in the current legislation by introducing a new norm. Methodology and methods: the article uses the comparative legal method of research, as well as the method of interpretation of legal norms that allow better understanding of the institutions of criminal law and determine the main directions of their development. Conclusions: the problem of imperfections in the current legislation is relevant for the study, as evidenced by judicial practice in criminal cases, discussions and works of legal scholars. The doctrine also emphasizes the need to observe the principle of justice in order to achieve the goals of the criminal law. The studied norm unfoundedly combines ordinary crime and a crime of a terrorist nature. Application of the results: this article may be of interest to students of higher education: bachelors, masters, postgraduates studying this area of criminal law, but also this material may be of interest to teachers of law schools, can be used as a guide for the preparation of practical and seminar classes.
