Abstract:
Goal - elimination of gaps in Russian civil law for regulation of commercial tenders by implementing of English case law best practices. Model - definition of key legal rules for tender regulation from leading cases in England. Conclusion - the author carried out analysis of key legal rules and principles of tender regulation in England in order to implement respective changes in Russian law for increasing of rights protection of tender counterparties. Scope of the article - part of the thesis of the author. Practical application - recommendation of the author can be of interest for business & legislation representatives. Social impact - elimination of breaches in commercial tenders caused by their uncertain legal nature. Value for purchasing professionals of multinational companies, as well as other legal entities, law-making bodies.
