Abstract:
The later period of the newest history can be as characterized as the world’s entry into a global critical conflict concerning the construction of the world order. The absence of a mechanism of preventing and solving the conflict creates not only a chronic tension, but also a great probability of crushes transferring that conflict to a deeper and accordingly to a critical level, which completely changes the legal character and the texture of the system of international relations. Undoubtedly the international law should act as an oprational mechanism of preventing and solving the conflict within the boundaries of the legal regulatory system of international relations and it should function only on the principle of “supremacy of law”. Of course, the large-scale and multi-level problem in question embraces all the conjugate cause factors. Thus its treatment requires a purposeful, comprehensive and all-round study of international law on the basis of multidisciplinary phenomenological synthesis. In this vein the present article describes the problem through the methodological instruments of the synthesis of Jurisprudence and Conflictology. The main emphasis is on the methodological format of presenting the legal system through the paradigm of legal conflictology, the main points of which are presented in the article.
