DISTRIBUTION OF COSTS AS A MEASURE OF RESPONSIBILITY IN ARBITRATION PROCEDURE

Background: Determination of the place of costs in ensuring of procedural discipline in arbitration process is an important task of the article. This issue draws attention draws attention, both the Russian scientists, and foreign experts in the field of civil legal proceedings. Seemed particularly interesting approach to the problem outlined by U.S. experts, such as Geoffrey C. Hazard, John F. Vargo and Henry Cohen. Methods: Technical and comparative legal methods are used in this article. This methodology allowed analyzing the legal nature of general and special rules of costs distribution from the view of the implementation of measures of responsibility in the arbitration process. Conclusions: The research showed that distribution of costs in arbitration process according to the general rule is not a measure of responsibility. At the same time the special rule of reference of costs on the person participating in process, in case of his unfair behavior, is a measure of responsibility having substantive character and procedural specifics of realization. Results: Author offered his original vision of the place of costs in arbitration process from the view of implementation of measures of responsibility in the arbitration process. Author’s conclusions focused both on further theoretical development and for use in practice.
