Abstract:
Objective: the main aim of the article is a discussion of the topical issues of use of analogy and subsidiary application of laws in criminal proceedings. In particular, the issue of conditionality applied various methods to overcome the law of criminal procedure socio-political motives. Research area: public relations in criminal proceedings in criminal investigation in respect of certain categories of persons. The article is devoted to the permissibility and necessity of application of analogy when resolving gaps arising from the proceedings in respect of special categories of persons. The author considers concrete examples of abuse of the right, as well as the situation in which the use of the analogy of the law or subsidiary application of the norms of the constitutional law can assist in the resolution of unsettled right situation. Conclusions: the use of analogy of law, as well as other ways of addressing gaps in criminal proceedings, to solve political problems in the absence of specific reasons for its use appears to be invalid. However, this method should be used when the actual occurrence of irregular right situations.
