Abstract:
The main trend in the development of modern legal systems is their increasing openness towards each other. The basis of this is the universal globalization of the legal space, leading to the creation of a unified system of legal values. The study of these circumstances is based not only on their great practical significance, but also have a clearly expressed scientific interest. The rapprochement of the law governing property turnover relations affects contractual relations to the greatest extent, and in the context of the latter issues of liability and remedies for non-performance and improper fulfillment of civil and legal obligations. The purpose of this study is to conduct a comprehensive, comprehensive comparative analysis of approaches to civil liability in the law of Latin America. The findings of the study are of a theoretical and applied nature. In particular, it has the property of confidence that the conclusion has been drawn that it is necessary to study responsibility from the point of view of a monistic, dualistic and elective approach. The results of the study can be useful to the judiciary, as well as law faculties of higher educational institutions for teaching the relevant courses.
