Abstract:
The task is to determine the factors on which depends the qualification of the relationship between the employee and the employer as an employment or civil law. Methodology - the research process the author used the method of comparative legal analysis, the method of system analysis, literal interpretation. The use of these methods allows us to comprehensively cover the issues that are the subject of this study and to correctly interpret the position of the judiciary on issues. Conclusions - Thus, the court is not bound by the Treaty, and will be guided by his essence (content) to an entity established between the parties to the relationship and apply accordingly civil or labour law. The article highlights qualifying features those and other relations, however, the set of such depends on the specific situation and is not exhaustive. Frame research the possibility of subsequent use of the results of scientific work (if applicable) - the main conclusions of this work are based on the analysis of the current legislation that creates a theoretical basis for further study of this institution. The practical value of the results of this study, first of all, the analysis of court cases, can be used in the practical work of judges, lawyers and legal educators. Social impacts - from the correct qualification of the relationship between the employee and the employer depend on such aspects as: jurisdiction of cases, methods of protection of civil rights, social guarantees for workers' rights, the duration of the limitation period, the amount of the state fee applicable law. Faithful qualification will help workers and employers take into account the negative experience and correct errors in the future. Originality/value - this work can be useful for students and law professors, practicing lawyers, representatives of business. The novelty of the research lies in the analysis of the new court practice 2013-2014.
