Abstract:

The article elaborates on the legality of withdrawal, including redemption, the land for public use for the purpose of subsoil use. The analysis of russian legislation, which establish a simplified procedure for registration of subsoil user rights on the land owned by the state or municipal property, and rules establishing the possibility of withdrawal from a private owner of land for public use for the purpose of subsoil use in case of failure by the parties agreement to sell the land or giving it on loan. The author comes to the conclusion that the relationship between mining companies and the owner of private property should be based on the principle of dispositive inherent in civil law
