Abstract:

Problem: The article is devoted to the analysis of lex mercatoria as one as a source of cross-border securities transactions regulation. During the research works of Alimova Y., Ablesgova O., Bahin C., Goldstain А., Schmitthoff C. and others were analyzed. Model: The article contains analysis of the rules and standard documentation developed by the International Swaps and Derivatives Association (ISDA), International Securities Lending Association (ISLA), International Capital Market Association (ICMA). Conclusion: The author makes conclusion on the importance of development and application of the new modern lex mercatoria in the process of cross-border securities transactions regulation, and points out the necessity of fuser development of the international non-governmental organizations work in this sphere.
