Abstract:
Background: In this article on the example of experience of different countries are reviewed and analyzed methods that protect the rights of employees in case of insolvency (bankruptcy) of the employer. In conditions of economic instability that began in Russia in 2014, there is a high social importance of this issue, which makes it of relevance. The aim of the research is to analyze and identify, based on overseas experience, the most effective ways of improving the protection of employee claims in insolvency of the employer in Russia. Along with local experts, research to develop the most effective measures of legal protection of employee claims in case of bankruptcy of the employer, shall be held by such foreign scientists as Janis Sarra, Wang, H.Y. Materials and methods: Methodological and theoretical basis for the study was the works of domestic and foreign experts in this field. Of great importance in theoretical and practical aspect was generalizing scientific principles and mechanisms for the protection of the employee rights connection with insolvency in foreign countries. During conducting the research and presenting the material were applied scientific approaches (system approach) and methods of scientific cognition (analysis, deduction, scientific abstraction). Conclusions: On the basis of the conducted research, accordance with current economic situation the author of the article gives conclusions, justifies it, The author gives their rationale, and suggests measures to improve the protection of employee claims in insolvency of the employer in Russian Federation. Thus, in particular, the author proves the inefficiency of the system of privileges and the need to implement the guarantee (insurance) institutions; analyzes and points out the advantages and disadvantages of measures that provide additional protection for employee on the example of foreign experience; the conclusions on the effectiveness of the application in Russia the project of the Federal law "On compulsory social insurance against loss of earnings due to insolvency (bankruptcy) of the employer". Target audience: The publication can be useful for scientists and practitioners involved with solving problems in the protection of employee claims in insolvency of the employer, and graduate students involved in the study of the considered problem
