Abstract:
The problem. The problem of this article is establishment of extremist and terrorist’s correlation, an emphasizing of specific characteristics each of these facts, which are criterions for offenses’ differentiation. The form. This work made by means of analysis of legal and regulatory framework devoted to extremism and terrorism’s opposition, also by means of study the materials of jurisprudence. The conclusion. Terrorism and extremism are different asocial phenomenons thereby the definition of terrorist organization in federal law «About action against terrorism» requires an elaboration. The definition of extremist action given in federal law «About action against extremist action» requires a modification too. It is necessary to exclude special position from this definition. According it a public justification of terrorism and another different terrorist actions refers to extremist action. The practical value. The practical value of this article consists in the possibility of using its recommendations by law enforcement officers who realize acts against extremists and terrorist offences. The singularity. This article has new theoretical positions and made by the author scientific advices on improving standards of Criminal Law of the Russian Federation. The complex comparison of extremist and terrorist offences was made and the recommendations for their delimitation were given. Suggestions for changes in criminal laws can be taken into account to the preparation for relevant bills, Plenum of the Supreme Court of the Russian Federation, can be used in next research on dissertation’s issues.
