Abstract:
The Constitution of Serbia of 1888 pays special attention to the protection of the rights and freedoms of minorities. In accordance with article 1 of the Serbian Constitution of 2006, one of the fundamental foundations of Serbia's constitutional order is the protection of minority rights and freedoms. In the Constitution of 2006 there is a special section 3 of the Second part of the Constitution, regulating the rights of persons belonging to national minorities. The guarantees stipulated by the Constitution of 2006 for the protection of the rights and freedoms of national minorities are supplemented by detailed legislation regulating the creation of instruments that protect the special rights of national minorities for self-government in the field of education, language use, and cultural development. In addition, the Serbian legislation provides for the formation and operation of structures that promote the participation of minorities in the management of public affairs (national councils), as well as the protection of national minorities from all forms of discrimination in the exercise of rights and freedoms. Analysis of regulation and protection of the rights of national minorities in the Republic of Serbia is the subject of this article.
