Abstract:
The institution of Constitutional Court is one of the most powerful instruments of constitutionalization of the state power. It ensures the supremacy of the Constitution, protection of the constitutional order and human rights and freedoms. The Constitutional Court exists in Serbia since 1963. However, at the initial stage, the Constitutional Court of Serbia did not play a significant role in protecting of constitutional values. One of the reasons for this was the lack of necessary legal instruments. A new stage of development of the Institute of the judicial constitutional control in Serbia was the adoption of a new Constitution in 1990. The new Constitution of Serbia qualitatively changed the place and role of the Constitutional court in the system of separation of powers. As a result the jurisdiction of the Constitutional Court had been significantly broadened. In particular, in accordance with the Constitution of Serbia of 1990, the Constitutional court was entitled to resolve electoral disputes. But the regulation of this authority was extremely narrow. The Serbian Constitution of 1990 provides that the Constitutional Court is competent to resolve electoral disputes which are not within the competence of courts or other state bodies. The detailed regulation of the content of this authority of the Constitutional Court should be established by Law, which was not adopted until the present time. The lack of detailed regulation has led to the lack of the practice of the Constitutional Court. At the same time, poor regulation of the content and scope of competence of the Constitutional court to resolve electoral disputes stimulated development of Serbian doctrine on this scientific and practical problem. As the result of this process - Serbian constitutionalists have attempted to develop a theoretical model of electoral dispute as an object of constitutional control, which would provide effective and inclusive protection of electoral rights. This theoretical model of electoral dispute had a significant impact on the regulation of authority of the Constitutional court in the Constitution of 2006 and in the Constitutional court Act 2007.
