THE DOCTRINE OF EQUALITY IN CONSTITUTIONAL LAW: ISSUES OF IMPLEMENTATION

In the present article the author considers one of the key issues facing a constitutional right and by society - doctrinal aspect of equality in constitutional law and practical application of equality in law and life. In an attempt to understand such close concepts as "equality" and "equality", the author comes to the conclusion that equality is a broader concept that includes the concept of "equality", the legislator uses the concept of "equality", thus emphasizing the sameness of rights, freedoms and duties of subjects before the law and the courts. Besides theoretical issues, the article analyzes the problematic issues faced by the society in the implementation of article 19 of the Constitution of the Russian Federation. Today, perhaps, the main task of modern constitutionalism is the optimal balance between declarativeness of legal equality and the reality of legal life of the individual and society as a whole.
