The problems of implementation at the preliminary hearing rules on public trial and the immutability of the bench

The article investigates the problem of application at the preliminary hearing of the general conditions of the trial, as publicity and permanence of the court. According to the author, not only the international principles of justice, but also the focus of the Russian criminal procedure policy to increase public control over the proceedings, determine the need for exceptions to the Code rules on the conduct of a preliminary hearing in a closed court session. Statutory prohibition for persons not involved in the case, to be present at the preliminary hearing cannot be explained by the secrecy of the issues. The article also explains the need for a preliminary hearing distribution rules of the immutability of the bench.
