Abstract:
Due to development of market relations in Russian Federation, necessity in protection of the employer’s rights from wrongful acts of the current and previous head of the organization has been increased. At the current moment, the respective rights of the employer according to Russian law are insufficiently protected in comparison with UK law. This article provides results of comparative analysis of limitation mechanisms of the head of organization freedom of labour according to Russian and UK law. The research is based on the analysis of Russian and UK legislation and court practice, as well as the respective Russian and foreign theoretical researches. This article is intended for students, postgraduate students, practical lawyers and other persons who interested in protection of the employer’s rights from wrongful acts of current and previous head of organization.
